Should judges making custody decisions by listening to the kids? Nowadays this is a hot topic in Household Law. Years ago the answer to the question was an emphatic "no". Kids were undependable witnesses, they did unknown what benefited themselves, and they would be shocked permanently by being asked to choose one moms and dad over the other. Moreover, they would find out that they were in a position to manage the outcome, which would turn the parent-child relationship upside down.
